Maury County Moves Forward with New Construction Impact Fees

During the July 2 meeting of the Maury County Admin Committee, County Commissioners discussed initial steps for implementing an impact fee on new construction in Maury County.
Earlier this year, the Tennessee General Assembly passed House Bill 2426, which was signed into law by Governor Bill Lee. This legislation allows counties, meeting specific criteria related to population growth from the latest U.S. Census, to impose impact fees.
This bill permits counties like Maury to temporarily raise their adequate facilities tax on new residential and commercial construction, up to $1.50 per square foot, pending a two-thirds majority vote by the county’s legislative body in two consecutive meetings.
Currently, Maury County charges 50 cents per square foot for residential construction and 30 cents for non-residential.
County Mayor Sheila Butt suggested that the new fees could start by September if approved in July and August. The Building & Zoning Director, Robert Caldiraro, will notify cities about the new fees and collection methods. The anticipated revenue increase is estimated to be $3 to $4 million annually.
Commissioner Gabe Howard expressed that although the bill wasn't ideal, it was a compromise acceptable to realtors and builders. He proposed a called meeting for the Ad Hoc Growth Committee to review the legislation in detail before the final vote.
Finance Director Doug Lukonen indicated that residential construction would likely generate more revenue than commercial construction, estimating an additional $3 to $3.2 million from the increased fees. These funds are designated for school capital projects, which would free up other county budget funds for different uses.
County Attorney Daniel Murphy noted that Maury County's private act might take precedence over the new law and mentioned the need for certification from the Tennessee Comptroller that Maury meets the growth criteria. He recommended seeking an attorney general opinion due to potential legal challenges.
The mayor questioned the necessity of delaying the process, suggesting that waiting was unnecessary. The new law states that if a county no longer meets the growth criteria, it can revert to the previous tax rates set by the private act.
Commissioner Brandon Nutt supported moving forward with the new fees quickly, while Commission Chairman Eric Previti shared Murphy's concerns about the new law’s issues needing resolution before taking action.
The committee voted to advance the resolution, with the required Commission votes scheduled for August and September.

On Saturday units were dispatched to the Duck River near Carpenters Bridge for an injured kayaker. A homeowner allowed us to use their private boat ramp for closer access. A raft was deployed and members were able to paddle a few hundred yards to retrieve the kayaker who had minor injuries.
